ORDINANCE NO. 1135 AN ORDNANCE REVISING THE SEWER RATES [This Ordinance has been approved and is in effect. It will be updated to the City Code in 2005.]
2. Statutory Authority. I.C., 36-9-23-25 3. City Code Citation Affected. Salem City Code Section 50.128. 4. Legislative Findings. A. That the present rates and charges charged by the Salem Sewage Utility do not provide sufficient revenues to meet the legal requirements providing for all expenses incidental to the operation of the sewage works, including legal expenses, maintenance costs, operating charges, repairs, lease rentals, and interest charges on bonds or other obligations; a sinking fund for the payment of principal and interest on bonds and the charges of bank and trust companies for making payment of principal and interest, and for the accumulation of a reasonable reserve for protection against default; adequate money to be used as working capital; and adequate money for improving and replacing the works. B. That sufficient rates and charges to pay the above referenced costs of operation are required by law and are necessary to provide for the current operation of the utility. The rates and charges for current operations are described herein as Phase I Rates and Charges. C. That the Common Council has provided for certain improvements to the sewage works pursuant to Ordinance No. 1132, adopted by the Common Council of the City of Salem on February 10, 2004. The rates and charges necessary to pay debt service on the bonds and provide for a debt service reserve fund are described herein as Phase II Rates and Charges. IT IS NOW THEREFORE ORDAINED AS FOLLOWS: 5.Ordinance. Section 1. Phase I Rates and Charges. That based upon the actual water metered and billed, the minimum monthly sewage bill for each customer, depending on the size of the water meter served at their location of usage, shall be as follows:

Section 3. That those rates for Phase I Rates and Charges
shall be effective as of May 1, 2004 and rates for Phase II Rates and
Charges shall be effective the month following the execution of construction
